What Is the Boater Freedom Act?
The Boater Freedom Act limits when law enforcement officers can stop and board your boat for inspection.
Previously, officers could conduct random safety inspections without any specific reason. Under the new law, that has changed.
No More Random Water “Pull-Overs”
Law enforcement can no longer randomly stop and board your boat solely to conduct a safety inspection.
Officers Now Need Probable Cause
Under the Boater Freedom Act, officers must have probable cause that a law has been violated before stopping your vessel.
This means:

They must suspect a boating law violation

They cannot stop you simply to check life jackets or safety equipment without cause
This change provides Florida boaters with stronger constitutional protections.
Important Exception: When Can Officers Still Conduct a Safety Check?
